GORTON, District Judge.
This case involves an insurance dispute arising from a flood at the Beth-Israel Hospital in Boston in 2004. After paying a claim, the hospital’s insurance carrier, as subrogee, brought this lawsuit against water and electric utilities maintaining equipment near the hospital.
