Motion of defendant the City of New York for summary judgment and dismissal of the complaint is denied.

Plaintiff James Reyes brought this action to recover monetary damages for injuries he allegedly suffered on April 12, 2004, during a baseball game that took place on a city playground in Staten Island, New York.
