BENTON, Circuit Judge.

Merwin R. Carlson appeals the district court’s

grant of summary judgment on his 42 U.S.C. § 1983 claim. Having jurisdiction under 28 U.S.C. § 1291, this court affirms.

Carlson provided trucking services to GMR Transportation, Inc., a North Dakota corporation.
