Calvin Corley (“Defendant”) appeals his conviction for assault in the second degree, a violation of section 565.060.

On February 20, 1998, Defendant drank some beer at a party. Defendant left the party with Rebecca Kirn

(“Kirn”), his girlfriend at the time, and was driving her car. At some point, Defendant passed another vehicle at a high rate of speed.
