This action arose out of Plaintiffs’ (collectively, Rudin) breach of contract claim against Palm Press, Inc. and its owner, Gus P. Kayafas (Kayafas). After Kayafas failed to file any responsive pleadings, the Court, pursuant to Mass.R.Civ.P. 55(b), entered a default judgment against him on the question of liability on September 29, 2007.
