plaintiff, Richard Max Strahan (“Stra-han”), against defendant Daniel Holmes (“Holmes”) for the entanglement of an endangered humpback whale

(Megaptera no-vaeangliae)

in Holmes’s fishing gear allegedly in violation of the Endangered Species Act (“ESA”), 16 U.S.C. § 1531

et seq.
