INTRODUCTION

This matter arises on Plaintiff Avery Dennison Corporation’s (“Avery”) motion for preliminary injunction, filed on July 21, 2008 (Doc. 16). Avery seeks to enjoin the Defendant, Alien Technology Corporation (“Alien”) with respect to two of the seven patents in suit, the '596 and '082 patents.
