Plaintiff The Heisman Trophy Trust (“The Heisman Trust”) brought this action alleging that defendant Smack Apparel Company (“Smack Apparel”) failed to comply with a settlement agreement that Smack Apparel had entered into with the predecessor to The Heisman Trust (the “Settlement Agreement!’).
