Steven Ray Garcia (appellant) appeals his conviction for driving while intoxicated, a third degree felony. His first two issues involve the trial court’s refusal to grant his motion to suppress evidence and to submit an article 38.23 instruction to the jury. His last issue involves the legal and factual sufficiency of the evidence supporting the verdict.
