OPINION & ORDER

Through this action, Plaintiff seeks damages under 42 U.S.C. § 1983 and 29 U.S.C. § 2611

et seq.,

the Family and Medical Leave Act (“FMLA”). The matter is currently before the court on Defendants’ motion to dismiss the FMLA claim. Consistent with the court’s normal practice, pretrial proceedings were referred to a magistrate judge.
