OPINION

GUADALUPE RIVERA, Justice.

The State Office of Risk Management (SORM) appeals the trial court’s award of attorney’s fees, stemming from the jury’s verdict in favor of Mae Davis.

We conclude the trial court erred by ordering SORM to pay Davis’s attorney’s fees, and therefore, we modify the trial court’s judgment to delete the award of attorney’s fees, and affirm the judgment as modified.
