Before the Court is a Motion for Summary Judgment, filed May 10, 2010, by the City of Council Bluffs (the “City”), Daniel Larsen (“Larsen”), and Lyle Brown (“Brown”) (collectively “Defendants”). Clerk’s No. 154. Curtis McGhee (“McGhee”) and Terry Harrington (“Harrington”) (collectively “Plaintiffs”) each filed a resistance to the Motion on June 3, 2010.
