Plaintiff Daniel T. Galena commenced this action under 42 U.S.C. § 1983,

claiming that his rights under the First Amendment were infringed when the Defendant Fiore Leone, then Chairman of the Erie County Council, ejected him from a public meeting of the Council held on March 20, 2007.
