In 2006, defendant Marvin R. Bodden (Bodden) left the employ of plaintiff People’s Choice Mortgage, Inc. (PCM) and joined defendant Premium Capital Funding, LLC (Topdot). PCM, alleging that Bodden violated a non-competition agreement and that Topdot participated in Bodden’s wrongful conduct, brought this action against both.
