Plaintiffs Geraldine Melnick (“Melnick”) and Lonnie Sehwimmer (“Lonnie”) (collectively “plaintiffs”) bring this diversity action against Cary Press (“Press” or “defendant”), seeking,

inter alia,

a partition of certain properties that Melnick claims to own jointly with defendant, the imposition of a constructive trust on another property,
