MEMORANDUM OPINION

Glen Ray Kelly was convicted of the felony offense of driving while intoxicated,

enhanced, and sentenced to 40 years in prison. TEX. PENAL CODE ANN. § 49.09(b) (West

Supp. 2010). We affirm.
