The plaintiff, Linda Kuczinski (“Kuczinski”) brought this action for a declaration that the original grantor of a lot known as “lot 5" did not reserve ownership of the proposed street shown on a plan as abutting lot 5. The case came on for trial on December 6, 2011. The trial consisted of stipulated exhibits and essentially amounted to a case stated.
