I. Introduction

The Town of Newton, Alabama-one of the defendants in this case—has moved to dismiss (Doc. # 5) the claims the plaintiff, Daniel Flowers (“Flowers”), has filed against it in this case. In response, Flowers filed a brief (Doc. # 16) contesting the Defendant’s motion.
