PROCEDURAL HISTORY

¶ 1. On September 30, 2010, James Ludwig entered a nolo contendere plea in Madison County Justice Court to one count of driving under the influence (DUI), first offense, and one count of careless driving. Ludwig appealed to Madison County County Court where, after a trial de novo, he was convicted of both charges.
