Appeal from an order of the Supreme Court (Me*1374Ñamara, J.), entered December 14, 2012 in Albany County, which denied plaintiffs motion to vacate a prior order of the court.

Plaintiff commenced this negligence action in May 2010 to recover for the damages sustained to his vehicle while it was parked in defendant’s lot.
