Plaintiff Progress Bulk Carriers (“PBC”) seeks indemnity from Defendant American Steamship Owners Mutual Protection and Indemnity Association (“American Club”) under a mutual indemnity contract PBC was a party to for losses incurred by a third party’s refusal to accept shipments of steel.
