BESOSA, District Judge.

Before the Court is defendant Aqua Gulf Express, Inc.’s unopposed motion to dismiss. (Docket No. 13.) For the reasons discussed below, the Court DENIES the motion to dismiss.

I. BACKGROUND

On May 20, 2011, plaintiff F.O.R. Roofing Contractor, Inc. (“F.O.R.”) contracted the transportation services of defendant Aqua Gulf Express, Inc. (“Aqua”).
