OPINION

This case arises out of an incident in which Defendant, police officer Kevin W. Gaul, while attempting to arrest Plaintiff Brian O’Donnell, backed his police car into *573the motorcycle O’Donnell was riding, causing him injury. O’Donnell alleges that Gaul struck him intentionally. Gaul argues there is no evidence that that the contact was intentional.
