This is a direct appeal of a criminal sentence against defendant-appellant Alex-sis J. Garcia (“Garcia”). Pursuant to an open plea agreement, Garcia pled guilty to two counts of distribution of heroin in violation of 21 U.S.C. § 841(a)(1) and (b)(1)(C).
