INTRODUCTION

Plaintiff Samuel J. Smolen (“Plaintiff”), an individual currently housed at Sing Sing Correctional Facility, commenced this action on January 30, 2004, pursuant to 42 U.S.C. § 1983, alleging that various defendant employees of Wende Correctional Facility (“Wende”) violated his Eighth Amendment rights. (Dkt. 1).
