Pending before the court is the defendant’s Motion to Recuse. [ECF No. 34]. The defendant asks that I recuse myself from this case pursuant to either 28 U.S.C. § 455(b)(5)(ii) or § 455(a) because of my son’s past tenure as United States Attorney for the Southern District of West Virginia.
