[¶ 47] I respectfully dissent.

I

[¶ 48] Mercier argues law enforcement’s warrantless search of his wallet and backpack violate the Fourth Amendment. The State contends the searches constitute an exception to the Fourth Amendment’s warrant requirement because they were incident to Mercier’s arrest.
