The Court has before it the parties' cross-motions for summary judgment.

The plaintiff-Nautilus, Inc.-and the defendant-ICON Health & Fitness, Inc.-are parties to a patent licensing agreement (the "contract"). Pursuant to the contract, Nautilus gave to ICON a license to incorporate Nautilus's patented technology into ICON's ellipticals.
