Leitsatz 1. NV: Eine französische Kapitalgesellschaft in der Rechtsform einer "societe par actions simplifiee" (S.A.S.) war bis zum 15. Dezember 2004 nicht als "Gesellschaft eines Mitgliedstaats" i.S. von Art. 2 Buchst. a i.V.m. Buchst. f des Anhangs der Richtlinie 90/435/EWG anzusehen.
