Leitsatz NV: Sowohl das Übergehen eines Beweisantrags als auch die Verletzung der Sachaufklärungspflicht kann im Nichtzulassungsbeschwerde-Verfahren nicht mehr geltend gemacht werden, wenn der Beteiligte hierauf i.S.v. § 295 ZPO (i.V.m. § 155 Satz 1 FGO) verzichtet hat.
