Leitsatz NV: Wird mit der Restitutionsklage die Wiederaufnahme eines Verfahrens angestrebt, in dem eine Beiladung erfolgt war, so ist der Beigeladene im Restitutionsverfahren nicht (nochmals) gemäß § 60 Abs. 3 FGO notwendig beizuladen.
